The cost of alternative dispute resolution in the Netherlands consists of three blocks: the fee of the neutral (mediator, arbitrator or binding adviser), the administration fee of the institution, and the cost of your own lawyer and experts. None of these is fixed by law; who ultimately pays is. In mediation the parties normally share the mediator’s fee, in arbitration the tribunal allocates the costs in the award, and in court the losing party pays the court fee and a fixed contribution to the other side’s legal costs under Article 237 of the Dutch Code of Civil Procedure (Rv).
Neutrals and institutions set their own tariffs and revise them regularly, and court fees and legal aid contributions change every year on 1 January. Ask for the current rate card before you commit; this page explains what will be on it and which choices move the total.

You pay for the neutral, the institution and your own advisers. The number of neutrals is the largest single variable: a three-member tribunal costs roughly three times a sole arbitrator for the same case.
Mediators usually charge by the hour or per half day or day. Arbitrators charge by the hour or day, or, in institutional arbitration, on a scale linked to the amount in dispute. Institutions such as the Netherlands Arbitration Institute (Nederlands Arbitrage Instituut, NAI) charge a registration and administration fee and call for an advance on costs that both parties pay in equal shares. If one party does not pay, the procedure is suspended until the advance is complete.
The third block is usually the biggest: your own avukat and experts. In a document-heavy commercial matter, counsel fees regularly exceed the tribunal fee several times over. VAT is charged at the standard rate of 21% on Dutch legal and neutral services; a Dutch business can normally reclaim it, a private individual cannot.
Arabuluculuk maliyetleri nasıl hesaplanır ve paylaşılır?
The mediation agreement you sign with the mediator fixes the rate, the payment split and confidentiality. There is no Dutch Mediation Act; most mediators are registered with the Mediators Federation Netherlands (Mediatorsfederatie Nederland, MfN), whose register courts use for referrals.
Arabuluculuk costs are short and front-loaded: an intake of an hour or two, one or two sessions of half a day or a day, and the drafting of the settlement. Dutch practice is an equal split of the mediator’s fee and venue costs, with each party paying its own adviser. A different split, for example a business bearing the full cost in a dispute with a consumer or employee, is common; agree it in writing before the first session.
The result is a settlement agreement (vaststellingsovereenkomst) under Article 7:900 of the Dutch Civil Code (BW), which binds you even if it departs from your strict legal position. It is not automatically enforceable. To instruct a bailiff without a judgment, record it in a notarial deed or, if proceedings are pending, in a court record (proces-verbaal). Our page on the yerleşim anlaşması explains this step.
Under the EU Mediation Directive (2008/52/EC) as implemented in Dutch law, a cross-border mediation suspends limitation periods, and mediators cannot in principle be compelled to testify about what was said. Mediation is also covered by subsidised legal aid: if your income and assets are below the statutory ceilings, the Legal Aid Board (Raad voor Rechtsbijstand) can grant a mediation permit (toevoeging), and you pay only a personal contribution.

Arbitration is regulated in Book 4 of the Rv. An arbitration clause takes the dispute out of the ordinary courts, and a court must decline jurisdiction if the other party invokes the clause before its first defence on the merits.
Registration fees are payable at the outset, and the tribunal will not proceed while the advance on costs is unpaid. The main cost drivers are, in order: the number of arbitrators, hearing days, the volume of documents and the number of experts. A sole arbitrator, one hearing block, an agreed page limit and a single jointly instructed expert reduce the bill without weakening your case. The NAI Arbitration Rules allow you to agree on a sole arbitrator, also for substantial claims.
Unlike mediation, arbitration produces a decision on costs. The tribunal fixes the costs, decides who bears them and may order one party to pay the other’s legal costs. It is not bound by the fixed cost scale of the civil courts, so recovery can be considerably fuller. Enforcement in the Netherlands requires leave (exequatur) from the provisional relief judge (voorzieningenrechter) of the district court, and a foreign award is enforced under the 1958 New York Convention.
An award can be set aside only on limited statutory grounds, such as the absence of a valid arbitration agreement or a conflict with public policy, and the claim must be brought within three months (Article 1064a Rv). Budget for one good procedure, not for an appeal, as we explain in our overview of Hollanda'da ticari uyuşmazlıkların çözümü.
Peki, bağlayıcı tavsiyeler ve tüketici uyuşmazlıkları çözüm mekanizmaları ne olacak?
Binding advice (bindend advies) is a settlement agreement in which the parties agree in advance to be bound by a third party’s decision. It is cheaper than arbitration but not directly enforceable: if the losing party does not comply, the winner still has to go to court.
The court sets binding advice aside only if holding a party to it would be unacceptable by standards of reasonableness and fairness (Article 7:904 BW). That high threshold makes binding advice a real end point in practice.
Most consumer disputes are decided by binding advice through the De Geschillencommissie (Consumer Disputes Committees Foundation) or, for banking, insurance and investments, by the Financial Services Complaints Institute (Kifid). Under the EU Directive on consumer ADR (2013/11/EU), these schemes must be free or available at a nominal fee for consumers. You pay a modest complaint fee, generally refunded if your complaint succeeds, and the affiliated trader bears most of the cost.
Maliyet açısından mahkemeye gitmekle kıyaslandığında nasıl bir fark var?
Court proceedings start with a fixed, published court fee (griffierecht) under the Court Fees (Civil Cases) Act (Wet griffierechten burgerlijke zaken), adjusted every year. The amount depends on the type of case, the amount claimed and whether you are a natural person, a legal person or a person of limited means.
The subdistrict court (kantonrechter) hears claims up to €25,000 and all employment, rental and consumer cases (Article 93 Rv); the court fees there are low. On the other hand, court proceedings are public, usually take longer than mediation or arbitration, and a judgment can be appealed.
The decisive difference is recovery. In Dutch Sivil dava the losing party pays a contribution to the winner’s lawyer fees based on the fixed cost scale (liquidatietarief), which sits well below actual fees. Intellectual property cases are the exception: Article 1019h Rv allows recovery of reasonable and proportionate costs actually incurred. Reasonable pre-litigation costs can be claimed under Article 6:96 BW, and for consumer debts they are capped by the Extrajudicial Collection Costs Decree (Besluit vergoeding voor buitengerechtelijke incassokosten).
That asymmetry is the real financial argument for alternative dispute resolution. It is cheaper when it ends the dispute early, and more expensive when it becomes a warm-up for litigation that follows anyway. In mediation each party bears its own costs whatever the outcome, so with a strong case against a stubborn opponent the court, where Article 237 Rv applies, can be the better choice. Our overview of Bir sorunu çözmek için mevcut olan prosedürler helps with that choice.
Ödeme konusunda size kim yardımcı olabilir?
Three funding routes matter: legal expenses insurance, subsidised legal aid and third-party funding. Most legal expenses policies cover mediation and arbitration as well as litigation.
If the insurer decides that outside representation is needed, you have a free choice of lawyer, confirmed by the Court of Justice of the EU in Sneller (C-442/12, ECLI:EU:C:2013:717). The insurer may cap what it pays, but it may not impose its own lawyer on you.
Under the Legal Aid Act (Wet op de rechtsbijstand), the Legal Aid Board grants a permit (toevoeging) if your income and assets in the reference year are below the ceilings; you then pay an income-related personal contribution, reduced if you first sought advice from the Legal Services Counter (Juridisch Loket). Third-party funders advance the cost of a claim for a share of the proceeds; in collective actions the court reviews their remuneration. Dutch lawyers may in principle not work on a no-win-no-fee or percentage basis; the only exception, for personal-injury and wrongful-death claims, has been a permanent part of the professional rules of the Netherlands Bar (NOvA) since 1 January 2026.
Hangi gizli maliyetlere dikkat etmelisiniz?
Unexpected invoices usually come from items nobody discussed at the start. Agree on them in the first procedural order or the mediation agreement.
- Adjournments: a hearing day vacated late is usually still charged. Fix firm deadlines for documents.
- Translation: certified translation is priced per word. Agree one working language and translate only what the tribunal will read.
- VAT at 21%: no cost for a business that can deduct it, a real cost for a consumer, foundation or exempt institution.
- Enforcement: a seat far from the debtor’s assets means paying twice, once to win and once to collect.
- The escalation clause: a tiered clause that makes mediation a precondition without a deadline gives the other side a free delay.
Anlaşmazlığın maliyetiyle orantılı nasıl tutarsınız?
Most cost control is decided before the first session. Choose a sole neutral unless the value or complexity requires three, and agree the fee basis in writing, including reading time, travel and late cancellation.
Use one jointly instructed expert instead of two opposing reports, and hold procedural hearings online. A chronological file, numbered exhibits and a two-page list of issues save hours of lawyer time. Put a tiered dispute resolution clause in your contracts while everybody is still on good terms, naming the institution, the number of neutrals, the language and the seat. Our medeni usul avukatları draft and review such clauses.

ÖZET
- Alternative dispute resolution costs three things: the neutral’s fee, the institution’s fee and your own lawyer and experts; none is fixed by law.
- Mediation costs are normally split equally; a settlement agreement only becomes directly enforceable through a notarial deed or court record.
- An arbitral tribunal can order full cost recovery, unlike the fixed cost scale in court, but arbitration requires an advance on costs.
- Court proceedings have a fixed annual court fee and only limited cost recovery, except in IP cases (Article 1019h Rv).
- Legal expenses insurance, legal aid and third-party funding can reduce what you pay yourself.
Sık Sorulan Sorular
Alternatif uyuşmazlık çözüm yöntemleri her zaman mahkemeye gitmekten daha mı ucuzdur?
No. It is cheaper when it ends the dispute early, and more expensive when a failed mediation or binding advice is followed by the court case you wanted to avoid. For a small claim before the subdistrict court, the court fee is modest and a mediator’s fee may exceed it.
Arabulucunun ücretini kim ödüyor?
Whatever the mediation agreement says. The Dutch default is an equal split of the mediator’s fee and venue costs, with each party paying its own lawyer. Agree a different split in writing before the first session.
Can you recover the cost of a failed mediation in later court proceedings?
Partly. Reasonable out-of-court costs to establish liability and obtain payment can be claimed under Article 6:96 BW. The costs of the proceedings themselves follow the fixed cost scale and are reimbursed only in part.
Karşı taraf masraflar için avans ödemesinin kendi payına düşen kısmını ödemezse ne olur?
In institutional arbitration the procedure is suspended until the advance is paid. You can pay the other side’s share to keep the case moving and ask the tribunal to order reimbursement in the award.
Mahkemeye gitmeden önce arabuluculuğu denemek zorunda mısınız?
Only if your contract says so. There is no general statutory duty to mediate in the Netherlands, although judges regularly refer cases to a mediator. If a valid escalation clause makes mediation a precondition, the court may hold your claim premature.
